SUMMARY:
The Legislative Counsel represents the Mille Lacs Band of Ojibwe Band Assembly in the lawful exercise of its constitutional and statutory duties and obligations and conducts legal research, drafts bills and legal opinions, reviews contracts, and performs other duties as assigned by the Secretary-Treasurer and Band Assembly.
The Legislative Counsel regularly interacts with the Secretary-Treasurer, District Representatives, Commissioner of Finance, Parliamentarian, and other legislative staff to achieve the goals and aspirations set by the Band Assembly. Legislative Counsel will provide competent responses and appropriate resolutions to difficult legal questions to Legislative Branch elected and appointed officials. In accordance with Legislative Order 27-20, The Legislative Counsel acts as a permanent supportive staff member to ensure the Mille Lacs Band Assembly has a sound governmental interest in preserving institutional memory and continuity in its processes.
QUALIFICATIONS:
· Graduate of an accredited American Bar Association law school with a Juris Doctor degree.
· A minimum of two (2) years of practical experience in Federal Indian or tribal law.
· Licensed to practice law in the State of Minnesota or willing to become licensed in the State of Minnesota. Willing to present a Certificate of Good Standing upon request.
· Knowledge of laws, regulations, policies, and rules relating to the Band.
· Ability to draft and amend resolutions, policies, orders, ordinances, and statutes and ensuring compatibility of the same with existing law.
· Capable of providing prompt legal advice, direction, and insight.
· Ability to work independently and exercise a team orientation.
· Excellent writing and verbal communication skills
· Ability to complete assignments in a timely manner.
· Windows software proficiency.
· Demonstrates an awareness and sensitivity to the Mille Lacs Band culture.
· Must provide a writing sample no more than eight (8) pages long.
· Must provide three (3) professional references.
DUTIES AND RESPONSIBILITIES
· Propose, draft, and amend resolutions, policies, orders, ordinances, and bills.
· Ensure compliance of the foregoing with the Constitution of the United States, Constitution of the Minnesota Chippewa Tribe, Indian Civil Rights Act, and applicable treaties and federal statutory and case law.
· Prepare informal opinions and memoranda on various legal issues presented by the Secretary-Treasurer, District Representatives, and Commissioner of Finance.
· Review Commissioner’s Orders and Opinions of the Solicitor after presentation to the Band Assembly.
· Evaluate agreements, contracts, cooperative and reciprocity agreements, and memoranda of understanding presented by the Executive Branch.
· Supervise and work with other legal staff in the Legislative Branch to draft bills.
· Collaborate with the Parliamentarian to effect legislative development.
· Attend Band Assembly meetings.
· Provide direction regarding the proper application of Mason’s Manual of Legislative Procedure.
· Attend Minnesota Chippewa Tribal Executive Committee meetings as requested.
· Perform other duties as assigned.
WORKING CONDITIONS:
· Must have a current valid driver’s license.
· Must be insurable under the Mille Lacs Band Drivers Insurance policy.
· Must pass a pre-employment drug and alcohol test.
· Background investigation required that shows no theft or fraud above a misdemeanor, no felony convictions, and no sexual or crimes-against-a-person conviction at any level. Any pending criminal cases must be disclosed in writing, including the date of the charge, the jurisdiction where the charge took place, and the status of the case.
· This is a hybrid position, with the expectation that the Legislative Counsel work 2 to 3 days a week in the office.
- Working hours are typically 8:00 a.m. until 5:00 p.m. Extra hours may be necessary to meet deadlines and sustain workload.
