Job description
This position is located in the Department of Public Works (DPW), Office of the General Counsel. The Office of General Counsel provides legal services to DPW, which is one of the larger District agencies, with approximately 1400 employees. DPW’s primary services include Solid Waste Management—collection and disposal of residential trash, street cleaning, sanitation enforcement, leaf, and snow removal; Parking Enforcement Management—public space parking enforcement, booting, towing, and impounding of vehicles; and Fleet Management—procurement, fueling, maintenance, repair and disposition of District owned vehicles. These operations generate issues regarding the delivery of DPW’s services, conduct of its employees, development and implementation of policies and enforcement of regulations.
Duties and Responsibilities
The attorney will represent DPW in adjudicatory and quasi-adjudicatory proceedings, including representing the Department before the Office of Administrative Hearings, which conducts administrative hearings on appeals of unemployment compensation and notices of violations issued under the Litter Control Administration Act. The attorney will also represent DPW before administrative tribunals, including the District’s Office of Human Rights and the U.S. Equal Employment Opportunity Commission, and manage all case responsibilities, including the prepares preparation of position statements, briefs, motions and other documents and evidence to support cases, as necessary.
The incumbent of this position should possess in-depth knowledge of several titles of law, policies, regulations, and procedures; federal and state laws related to DPW’s functions; as well as precedent in the form of agency and judicial decisions; skill in interpreting and applying legal knowledge in various situations; knowledge of research strategies and techniques sufficient to research the most complex legal issues.
Incumbent also will:
- Advise on personnel matters and reviews disciplinary actions.
- Serve as a senior attorney in DPW, managing the more complex and difficult matters.
- Review various legal documents and relevant case law to determine whether execution or non- execution of proposed actions is in the best interest of the District of Columbia government and provides statement of reasons and draft language necessary to obviate objections.
- Examine and analyze proposed orders, legislation, rulemakings, and other legal documents from various sources for legal sufficiency, both as to form and substance.
- Perform the aforementioned research and provide oral or written opinions resulting from such analysis.
- Review and analyze records of hearings, including briefs filed, exception taken, rulings made, tentative decisions, and reports of findings of facts and conclusions of law; analyze same and provide recommendations to supervisor as appropriate.
- Prepare memoranda on legal questions and proposals and drafts tentative final decisions for consideration by concerned administrative agencies.
- Consult frequently with officials of various administrative agencies, providing advice as to the extent of their legal duties and powers.
Qualifications and Education
Applicants must possess one (1) year of specialized experience at the lower grade that has equipped the applicant with the particular knowledge, skills, and abilities (KSA’s) to perform successfully the duties of the position, and that is typically in or related to the position to be filled. Applicants must be a graduate from a full course of study in a School of Law accredited by the American Bar Association at the time of appointment.
Licensures and Certifications
Applicant must be an active member in good standing of the bar of the District of Columbia or be eligible to waive into the D.C. Bar. If eligible for waiver, incumbent must apply for admission prior to commencing employment and successfully obtain admission to the D.C. Bar within 360 days of commencing employment. Applicant shall remain a member in good standing of the D.C. Bar while employed in the Legal Service.

Salary Range: $128,795 - $167,437 Per Annual, based on funding
