HOME-ARP Division
This is a temporary position associated with one-time federal funding under the American Rescue Plan Act. The position is estimated to be filled through approximately December 2026, with possibility of extension.
GENERAL DESCRIPTION:
Performs highly advanced complex and technical work in the planning of administration and enforcement compliance requirements for HUD – Community Planning Developments federally assisted multifamily projects projects that are subject to the Davis Bacon Act and related federal labor laws and HUD Section 3 requirements. This FTE will perform work for the HOME-ARP Program (the HOME Investment Partnerships American Rescue Plan Program), a program focused on serving persons experiencing homelessness and other vulnerable populations; and for the Multifamily Finance Division for its HOME annual, Neighborhood Stabilization Plan and National Housing Trust Fund activities. Work involves providing consultative and technical assistance to other TDHCA staff, governmental agencies, community organizations, developers and their construction teams, and the general public. Work is performed under the direction of the Manager of the HOME-ARP Division with minimal supervision and with considerable latitude for the use of initiative and independent judgment.
SPECIFIC JOB RESPONSIBILITIES:
- Provides consultative services and technical assistance to Owners and Developers to prepare for and operate in compliance with federal labor laws; prevailing wage standards and Section 3 regulatory mandates and policies.
- Acts as liaison with federal agencies and internal programs to explain the programs and federal requirements.
- Oversees the analysis, implementation and documentation of Department policies.
- Ensures Owners subject to HUD Labor Standards regulations, Davis Bacon and related Federal labor laws certify acknowledgement of labor law compliance mandates prior to the disbursement of federal funds (initial and final).
- Work includes, but is not limited to, conducting the pre-construction conference, ensuring a Labor Standards Officer is appointed, issuing ‘Notice to Proceed’ (Ten Day Call) on behalf of TDHCA authorizing the start of project construction and stipulates required Department of Labor prevailing wage mandates that must be paid to project laborers and mechanics throughout project construction, reviewing weekly payroll reports for compliance with labor standards, and submitting the semi-annual labor standards enforcement report (form 4710) to HUD.
- Oversees the development of policies, procedures, manuals, forms, and standards and plans activities in accordance with federal and state objectives and goals.
- Responsible for the creation, completeness and maintenance of HUD Section 3 requirements for each contract file.
- Maintains current knowledge of Department procedures, regulatory requirements and federal wage rates pertaining to federal labor standard requirements and documentation.
- Maintains current knowledge of Department procedures and federal regulatory requirements pertaining to Section 3 compliance.
- May interface with HUD to assist with violation resolutions of DBRA or Section 3.
- Provides assistance and technical assistance to divisional and departmental staff.
- Performs entries into and maintains division program databases and information systems in a timely manner.
- Determines trends, resolves operational problems and makes recommendations to management.
- Conducts administration and technical assistance workshops and speaks to community and professional groups.
- Collects, organizes, analyzes, and prepares material in response to requests for information, correspondence and reports.
- Consults with public and private agencies involved in the programs to resolve problems, identify training needs, and discuss program effectiveness.
- Performs related work as assigned.
- Responsible for becoming fully knowledgeable of the Department’s Fraud, Waste and Abuse Prevention and Detection Program including reporting mandates.
- Travel as required, approximate travel is 10%.
EDUCATION/EXPERIENCE:
- Graduation from an accredited four-year college or university with major course work in communications, public administration or business administration preferred.
- Experience in the administration of a state or federal housing program is generally preferred.
- Experience or education may be substituted for one another.
KNOWLEDGE, SKILLS AND ABILITIES:
- Extensive technical knowledge of federal programs; of public administration and management techniques; and of program planning and implementation is preferred.
- Must have 3 or more years of experience with Davis-Bacon and Related Acts oversight and compliance on federal programs.
- Extensive knowledge of State and/or Federal labor standards, including, but not limited to, Davis-Bacon Act, Copeland (Anti-Kickback) Act, Federal Labor Standards Act, and Contract Work Hours and Safety Standards Act required.
- Extensive knowledge of Section 3 of the Housing and Community Development Act and related policies. Preference for experience with Section 3 compliance and reporting.
- Must possess the ability to gather, assemble, correlate, and analyze facts; to devise solutions to problems; to prepare concise reports; and to develop and evaluate policies and procedures.
- Must possess the ability to establish and maintain effective working relationships with coworkers, state agencies, local government officials, and the general public.
- Must possess proficient knowledge and skill in the use of Microsoft Office including Word, Excel, Powerpoint, Outlook, and Access.
- Must possess excellent written and oral communication skills.
- Must possess the ability to speak to the public. Experience in both small and large settings, ability to organize and produce cogent presentations.
- Must possess the ability to adapt to changing workloads and deadlines.
- Must possess the ability to set priorities and organize workload.
PHYSICAL REQUIREMENTS:
- This classification functions in a standard office environment. Ability to drive and travel as needed. Will need to move about the office to access file cabinets, use office machinery, attend meetings in various offices and conference rooms, etc. Must be able to communicate and exchange accurate information via phone, computer, and in person. Must be able to observe and evaluate data in a variety of formats, including hard copy, electronic, and various media formats. Must be able to work non-standard hours including the ability to work beyond 40 hours per week as needed and in compliance with the FLSA.
- The employee must be able to lift and/or carry up to 10 pounds. Must be able to push and/or pull up to 10 lbs
OTHER:
Must be willing to work in a non-smoking environment and adhere to all applicable Department policies and procedures. Must be willing to work overtime if necessary which may include nights and weekends. Must attend work regularly and adhere to approved work schedule.
